Virginia DUI: In mid-March, 2017, Montana Fishburne, the daughter of actor Laurence Fishburne, was arrested for DUI in Broward County, Florida. Fishburne was involved in a two vehicle crash on I-95 near Fort Lauderdale. According to police, Fishburne struck a Range Rover from the rear with her Toyota Corolla. The Range Rover had reduced speed due to an accident ahead. Police claim that Fishburne was not in possession of her faculties as she roamed the accident scene and at one point urinated on the shoulder of the interstate.
Virginia DUI: According to the Florida Trooper who arrested Fishburne, she had red eyes, a strong odor of alcohol on her breath and spilled wine in her front seat. Fishburne apparently attempted the standardized field sobriety tests and was unsuccessful as are most people, impaired or not, who attempt them. Fishburne registered a .177 and a .181 on breath testing devices employed by Florida law enforcement. Fishburne has made some questionable choices in her young life — first doing a porn film in an attempt to break into show business. This choice was followed by a career as a stripper.
Virginia DUI: The standardized field sobriety tests (SFSTs) are a way to generate probable cause to arrest. When sober people are tested they typically generate enough clues on these tests to justify arrest for DUI. The media talks in terms of pass/fail for the SFSTs but actually they are designed to demonstrate a probability of a blood or breath alcohol content over the .08 legal limit.
