Bruce Springsteen’s .02 BAC DWI Arrest

On November 14, 2020, a highly trained law enforcement officer arrested Music Icon Bruce Springsteen for DWI, Reckless Driving, and Consuming Alcohol on Government property. This brought back the age-old question:

The Government maintains that on the Horizontal Gaze Nystagmus (HGN) test, 4 clues equal a Blood Alcohol Content of .08 or better. According to the Government, the HGN is never wrong. However, in the arrest of Bruce Springsteen, where he failed 4 out of 6 clues, he had a BAC of .02, which means these tests are fallible. 

The arresting officer had training and experience in administering the standardized field sobriety testing (SFSTs). According to law enforcement, the SFSTs are almost magical in their ability to determine whether a subject’s blood alcohol content is above or below the .08 level.

The SFST tests are the HGN eye test, the walk and turn test and the one-leg stand test.

An on-duty officer noted that he witnessed Springsteen consume a shot of liquor and then get back on his motorcycle and start it. The Officer detained Springsteen and told him that possessing alcohol at Sandy Hook, NJ was illegal.

The Officer noted that the shot was taken from a 750ml bottle of Patron, that was then completely empty.

Under the Officer’s skilled interrogation, Springsteen admitted that he had planned to leave the park and consumed two shots in the last 20 minutes.

According to the Officer, Springsteen’s eyes were glassy, and he emitted a strong odor of alcohol. The Officer ran Springsteen through standardized field sobriety tests. On the super magical, super accurate, never wrong eye test, the Horizontal Gaze Nystagmus (HGN) test, Springsteen displayed 4 out of 6 clues.

Which for the Government means: home run, game over!

The Government’s HGN says Springsteen is .08 or better. But is it really?

Moreover, Springsteen was visibly swaying back and forth while the officer observed his eyes. Not an HGN clue but extremely damning.

The Officer observed 5 out of 8 clues on the walk and turn test. (Another Government test that is never wrong.) According to the Government, 2 or more clues showing means a blood alcohol content of .08 or more!!!

According to the Government, Springsteen was so out of it that he took 45 total steps instead of the 18 steps!!!

Apparently, the one-leg stand test was not attempted.

The news of Springsteen’s arrest emerged just days after the premiere of his first-ever Super Bowl Commercial.  Jeep officials paused the commercial pending the outcome of charges.

Springsteen was arrested and tested for his blood alcohol content.

The Government tests were wrong. Springsteen’s BAC was .02, not .08, the legal limit in New Jersey. .02 is well below the legal limit. Springsteen was not drunk, was not impaired, and it was not illegal for him to operate a motor vehicle.

Springsteen was innocent despite the admission of drinking, the strong smell, the glassy eyes, the HGN eye test, and the walk and turn test.

The Government’s magical tests were wrong with the Boss; they are often wrong.

The SFSTs magic is just Government propaganda.
